1. The Retreat, Darjeeling (‘THE RETREAT, DARJEELING/us’) respects an individual's right to privacy. This policy lays down our practices with respect to collection, confidentiality, and disclosure of Personal Information. Please familiarize yourself with our privacy practices, as given below. We are an organisation based and existing in India and are thus bound by the laws of the Union of India. This Privacy Policy has been prepared in accordance with applicable Indian laws.

What is collected

3. We may collect Personal Information (‘Personal Information’) from you such as:

  1. Personal contact details such as name, alternate name, title, addresses, telephone numbers, and personal email ID

  2. Date of birth, age, anniversary, and/or special occasions

  6. Next of kin and emergency contact information, pseudonymous email address

  7. Copy of Government issued ID Card, as applicable on the location of the hotel

  8. Copy of Passport and Visa as applicable on the location of hotel

  9. Reservation information and travel itinerary such as duration of stay and other related details and your loyalty program membership ID/details

  10. Photographs

  11. Bank account details, credit/debit card information

  12. CCTV footage and other information obtained through electronic means such as door access records, internet systems (including wired or wireless networks that collect data about your computer, smart or mobile device), card key, POS devices, and other security and technology systems in the Hotel.

  13. Information about your use of our information and communications systems

  14. Preference and interests including but not limited to dietary preferences, allergy details, health condition, and any special requests made by you and observations about your service preferences (including room and food preferences)

  15. Information about how you use our services (online and at the hotel) and about how you use our website/mobile application.

  16. Additionally, in some circumstances, we may also collect:

    - Voice Recordings: This includes recordings of your interactions, such as customer service calls, which are captured for quality assurance purposes.

4. While collecting any Personal Information, The Retreat, Darjeeling indicates the purpose of collection of such information and gives the person providing the information an option of not providing the information. In such cases, The Retreat, Darjeeling may choose not to provide any services/supply goods for which the information was necessary. You hereby accept and agree that we shall not be held liable in any manner whatsoever if we are unable to perform our services or if there is a deficiency in our services to you due to your failure to provide such information.

5. If you are under 18, you may use our services only with the consent of your parents/ legal guardian. As a general rule, we do not intentionally collect sensitive personal information or personal information about children under the age of 18, except wherein contractually obligated to provide services and with the consent of a legal guardian or parent. If we become aware that we have inadvertently collected such information about children under the age of 18, we will take steps to delete the information as soon as possible, except where we are required by applicable law to keep it or where the collection/use of the same has the consent of their parent or legal guardian.

Where you are making a booking on behalf of other visitor or customer, it is your responsibility to represent that visitor or customer in the booking process and explain to the visitor or customer how we will use their Personal Information as set out in this Privacy Policy. Consent from such visitor or customer is deemed to be in place when you enter into a transaction with us and share their details with us enabling us to reach out to them. If you enter into a transaction for some other person, we may collect your billing information but may communicate with the customer directly about the service transacted.

  8. In addition to the collection of Personal Information, while you visit our website/mobile applications, we automatically receive and record certain information of your session. These files merely log visitors to the website which is a standard procedure for hosting companies and a part of hosting services’ analytics.
